Regulations for Receipt of Goods (Alcohol)

  1. General Provisions

1.1. These Regulations set out the rules for granting a one‑time power of attorney to receive goods containing alcoholic beverages ordered via the cultsool.com online store (“Store”).

1.2. The sale and handover of alcohol take place at the Seller’s licensed stationary point of sale in Poland. The Website serves only as an online ordering channel.

1.3. By selecting courier delivery for an order containing alcohol, the Customer grants the Seller and the carrier designated by the Seller (the “Courier”) a one‑time power of attorney to collect the goods on the Customer’s behalf from the stationary point of sale and deliver them to the address specified in the order.

2. Scope and nature of the power of attorney

2.1. The power of attorney is one‑time and applies only to a single, specific order.

2.2. The power of attorney authorises the Courier to:

  • collect the goods on the Customer’s behalf from the Seller’s stationary point of sale;

  • transport and deliver the goods to the address specified by the Customer;

  • perform any acts necessary to hand over the goods (including confirming receipt).

2.3. The Courier may delegate performance to its employees or subcontractors to the extent necessary to deliver the shipment.

  1. Requirements for the customer and recipient

3.1. The Customer declares that they are at least 18 years old and are not subject to any prohibition under Article 15 of the Act on Upbringing in Sobriety and Counteracting Alcoholism.

3.2. The Customer declares that they are not purchasing alcohol for the purpose of resale, unless they are an authorised business entity and comply with all legal requirements.

3.3. The person receiving alcohol from the Courier must be at least 18 years old, sober, and legally entitled to purchase alcohol under the law applicable at the place of delivery.

3.4. The Courier has the right and obligation to refuse to hand over alcohol if:

  • the recipient fails to present valid identification;

  • there is reasonable doubt as to the recipient’s age, sobriety, or legal entitlement;

  • handover would be contrary to applicable law.

4. Personal data

4.1. The Customer consents to the transfer of their personal data and the recipient’s data to the Courier to the extent necessary to perform the power of attorney and deliver the goods.

4.2. Data processing is carried out in accordance with applicable data protection laws (GDPR).

  1. Liability and refusal of performance

5.1. The Seller and the Courier reserve the right to refuse to issue or deliver alcohol in the situations described in Section 3.4.

5.2. If refusal is due to reasons attributable to the Customer or recipient, the Seller may deduct costs already incurred (including any proxy/courier fee), in line with the Store Terms and Returns policies.

  1. Amendments

6.1. The Seller may amend these Regulations for important reasons, in particular due to changes in applicable law.
